Terms

Terms of use

These are the terms for using Diverge. They are written to be read — if any part of this is unclear, ask us and we will either explain it or fix the wording.

The agreement

By using Diverge you agree to these terms. The service is provided by Diverge. If you don't agree with something here, the answer is not to use the product — and if the reason is something we could fix, we'd rather hear it.

What Diverge is not

Diverge is a support tool. It is not a medical device, and it does not provide medical, clinical, psychological or legal advice.

It does not diagnose anything and it is not a treatment for anything. Nothing it shows you is a professional opinion, and it is not a substitute for care from someone qualified to give it. If you are in crisis, please use these resources, or call 999 if there is immediate danger.

Your account

You can use the whole product without an account. If you make one, you are responsible for keeping your password to yourself, and for what happens through your account while you're signed in. Tell us if you think someone else has access to it.

One person per account. You need to be 13 or older to make one, and if you are under 18 you should have a parent or guardian's agreement to these terms.

Your content stays yours

What you write in Diverge belongs to you. We claim no ownership of it. We store and transmit it only to give it back to you on your own devices, and to work out what to show you next — the detail is on the privacy page. You can export it whenever you want, and deleting your account deletes what we hold.

What you agree not to do

  • Break into it, or try to reach other people's data.
  • Use the product's model requests as a general-purpose service for something else — the endpoint exists to break your own tasks into steps.
  • Resell access, or run it as a service for other people.
  • Anything illegal, or anything that harms someone else.

If any of that happens we may suspend or close the account. Where the situation allows it, we will say why first.

Paying, pausing and cancelling

The product is free to start and needs no card. If you subscribe later:

Cancelling
A button in settings. Not an email you have to write, and not a phone call. It takes effect at the end of the period you have already paid for.
Pausing
Also a button, and it stays paused for as long as you need. Your data is waiting when you come back.
Price changes
Told to you by email before they apply, with enough notice to cancel first.
Refunds
Your statutory rights apply. Beyond those, if you paid for something you didn't get, write to us and we will sort it out.

Availability, and changes to the product

We will try to keep the service running and to keep your data safe, but we can't promise it will never be unavailable. The product works on your device without a connection, which is the main protection against our end being down.

Features can change. If we ever have to close the service down, we will give notice by email and leave enough time to export your data.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, or for anything you decided to do or not do because of what the product showed you.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, your statutory rights are unaffected by any of this.

Changes to these terms

If these terms change, the date at the foot moves. Anything that materially changes what you agreed to will be told to account holders by email rather than left here to be found.

Law

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer elsewhere, this does not take away protections you have under the law of the country you live in.
